Solid Waste collections provided herein. To the extent these services are within the scope of the <br />Contractor's Exclusive Franchise under this Agreement, the additional charge to the Customer for <br />such services shall be determined between the Contractor and the Customer prior to provision of <br />the services if not otherwise part of the Rate Schedule or Special Charges Schedule. <br />B. The City~nonsored Events. Upon request of the City, the Contractor shall provide at no <br />cost, Solid Waste collection service and Recycling service at up to five (5) City sponsored events <br />per annum. (See Appendix 2.) Each event may be more than one day in duration. For both Solid <br />Waste and Recycling, the Contractor shall provide such Containers as are reasonably necessary <br />to provide convenient access to the public. The Contractor shall empty such Containers as <br />needed during each event to ensure Containers have capacity for public use during the event <br />4.13 TRANSFER AND DISPOSAL OF SOLID WASTE <br />A. Disposition of Unauthorized Waste. The Contractor shall implement procedures to identify <br />and reject materials delivered to the Disposal Site, Recyclables Processing Facility or Green <br />Waste Processing Facility which are Hazardous Wastes, or which otherwise may not be legally <br />accepted under its permits and other applicable governmental regulations then in effect. <br />The Contractor may, in the course of implementing such procedures, refuse to accept materials <br />proposed to be deposited from the Customers if they constitute Hazardous Waste, or otherwise <br />may not be legally accepted at the Disposal Site, Recyclables Processing Facility or Green Waste <br />Processing Facility and shall be solely responsible for material which is accepted. If the Contractor <br />discovers such Hazardous Waste among materials which it has accepted, it shall dispose of such <br />Hazardous Waste at its own expense. The Contractor may pursue all legal rights and remedies it <br />may have against the waste generator(s) of such Hazardous Waste, if the waste generator can be <br />identified. <br />B. Wei hin . <br />1. Maintenance of Scale Systems. The Contractor shall operate, maintain or use an <br />adequate scale system at the Disposal facility. All scales and weighing equipment shall be <br />kept in good and accurate condition operating at the standards of accuracy and reliability <br />specified in Title 4, California Code of Regulations, Articles 8 and 9. The Contractor shall <br />request that the appropriate governmental agency inspect all scales and weighing <br />equipment at least once per year. If a scale or weighing equipment is found to be <br />measuring inaccurately and the errors are outside the tolerances allowed in Title 4, <br />California Code of Regulations, Articles 8 and 9, the Contractor shall promptly repair or <br />recalculate such equipment so it operates accurately. If the Contractor does not legally <br />control the scales, the Contractor shall be responsible for alternative means of weighing. <br />2.
