Notwithstanding the terms of such use permit, the Contractor shall obtain the City's approval of any <br />expansion of the facility or any increase in the volume of materials collected, processed and stored <br />there to the extent that such expansion and/or increase in volume (measured either by tons or <br />cubic yards) is due to customers of the Contractor other than the City of San Leandro. Therefore, <br />should the Contractor obtain other customers, franchises or collection agreements other than for <br />San Leandro, then such increase in volume, capacity or physical expansion shall be approved, <br />conditionally approved or denied by the City. <br />Contractor guarantees adequate capacity, not exceeding permitted volume limits, to the City at the <br />Aladdin Facility throughout the term or any renewal. To the extent that the Aladdin Facility, or other <br />Contractor facilities used in providing Franchise Services are also to provide services other than <br />Franchise Services, the Contractor shall track and recover such data as is necessary to accurately <br />allocate to the City its share of all expenses, revenues, incoming and diverted Tons of Recyclable <br />Materials, and incoming and diverted Tans of Green Waste, and Tons of Residue related to <br />provisions of Franchise Services. The Contractor shall provide the same information for all other <br />jurisdictions ar other entities using the facility, and shall make such information available to the City <br />Representative upon written notice. By July 1, 2000, the Contractor shall develop and submit for <br />the City's review and approval a method(s) for making the allocations specified in this paragraph. <br />ARTICLE 5. OTHER FRANCHISE SERVICES <br />5.1 EMERGENCY COLLECTION <br />The Contractor will provide collection services in order to remove emergency debris, as determined by the <br />City Representative. The Contractor will provide one Debris Box vehicle to be available at all times at <br />Aladdin Street for the purposes of emergency collection. Emergency collection under this section is <br />collection in the absence of the declaration of a local disaster. <br />5.2 PUBLIC EDUCATION AND AWARENESS <br />A. General. The Contractor is responsible for two key elements of Customer awareness and <br />education: (1) the availability of the Contractor services and changes in those services; and (2) maximizing <br />participation in diversion programs. The Contractor acknowledges and agrees that education and public <br />awareness are critical, key, and essential elements of achieving the requirements of AB 939, and <br />acknowledges its primary responsibility for conducting an aggressive, consistent, and effective public <br />education and awareness program throughout the Term, and at no cost to the City. The Contractor also <br />will cooperate with the City in exploring opportunities to expand public and consumer awareness over the <br />Term. <br />B. Specific Responsibilities.
