materials placed in the collection containers giving reference to the section of the City Ordinance or to the <br />section of this Agreement which has been violated, and which gives grounds for Cantracta~'s refusal. This <br />infprmation shall either be in writing or by means of a check system. Contractor shall maintain, at <br />Contractor's place of business, a logbook listing all complaints and taggings. Said logbook shall contain <br />the names and date and manner of disposition of each case. Such log shall be kept so that it may <br />conveniently be inspected by representatives of the City upon request. <br />Load Checking <br />The Contractor is responsible for inspecting all materials prior to collection for hazardous waste or other <br />unacceptable materials. The Contractor is not responsible for collection of hazardous waste or other <br />unacceptable materials. <br />The Gontractar is responsible for controlling contamination levels of the recyclables materials and green <br />waste through public education efforts and tagging of improper setouts. <br />Litter Abatement <br />Minimization of Spills <br />Contractor shall use due care to prevent materials placed in the collection containers from being spilled or <br />scattered during the collection or transportation process. If any material is spilled during collection, the <br />Contractor shall promptly clean up all spilled materials. Each collection vehicle shall carry a broom and a <br />shovel at all times for this purpose. <br />Contractor shall not transfer loads from one vehicle to another on any public street, unless it is necessary <br />to do so because of mechanical failure or accidental damage to a vehicle. <br />Cleanup <br />During the collection transportation process, the Contractor shall clean up litter in the immediate vicinity of <br />any storage area (including the areas where collections bins are delivered for collection) of any materials <br />that escape from the collection vehicle or collection containers as a result of the Contractor's service. In <br />the event that litter not caused by the Gontractor's service is in the vicinity of the storage area, the <br />Contractor is required to clean up this litter whether or not Contractor has caused the litter on aone-time <br />basis and shall discuss the spillage directly with the customer responsible and shall report such instances <br />to the City. The Contractor shall work with the customer to resolve the spillage problem. City will attempt <br />to rectify such situations with the customer if Contractor has already attempted to do so without success. <br />Covering of Loads <br />All materials shall be contained or covered during transportation to the disposal or processing site. No <br />material shall be transported to the disposal site or processing facility in vehicle hoppers. <br />DRAFT i/z4/oo Page 6 of 11 <br />
