<br />Downtown TOD Strategy <br /> <br />7 <br /> <br />September 4, 2007 <br /> <br />. Staff has responded to approximately 30 calls and e-mails from affected property owners <br />and nearby residents regarding proposed Zoning Code Text and Map changes. One of <br />these inquiries led to review and correction of the DA-1 District boundary and is reflected <br />in the proposed Zoning Map. <br /> <br />Current City Council Policy <br />Not applicable. <br /> <br />Previous City Council Action(s) <br />The City Council has heard periodic updates of the Transit-Oriented Development Strategy, <br />including a Work Session, during 2006 and 2007 at City Council meetings. There has been no <br />previous City Council action. <br /> <br />City Council Committee Review and Action <br />Not applicable. <br /> <br />Applicable General Plan Policy <br />The TOO Strategy included 108 General Plan Policies. The EIR incorporated these policies and <br />numerous General Plan EIR Mitigation Measures as part of the TOO Strategy. The EIR found <br />that the Downtown TOO Strategy is in substantial compliance with the General Plan. <br /> <br />Permits and/or Variances Granted <br />Not applicable. <br /> <br />Environmental Review <br /> <br />. The Public Draft TOO Strategy was the subject of a Draft Environmental Impact Report <br />(DEIR) that was circulated for a 45-day public comment period from June 5 to July 19, <br />2007. A public hearing was held on July 12 to allow members of the public to provide <br />verbal comments, in addition to written comments, on the TOO Strategy and DEIR. A <br />Response to Comments document was prepared to address the comments received during <br />the comment period (Please see Attachment E). This document, in combination with the <br />Draft Environmental Impact Report, comprises the Final Environmental Impact Report. <br />Certification of the Final EIR must occur before the City Council may adopt the TOO <br />Strategy or adopt the proposed Zoning Code (Text and Map) Amendments. <br /> <br />. A Summary of Environmental Impacts, which provides a summary of the environmental <br />impacts covered in the Draft Environmental Impact Report, is attached for City Council <br />reVIew. <br /> <br />. Three comment letters were received after the close of the comment period and prior to <br />the Planning Commission meeting of August 23, 2007. These letters were reviewed by <br />staff and the environmental consultant and it was determined that the topics were <br />generally addressed by the FEIR and no new issues came up. <br /> <br />. A letter was received from Rutan and Tucker, LLP, on behalf of Norcal AI, LLC, on <br />August 29, 2007 at 9:31 a.m. via fax. The comment period on the EIR was June 5 to July <br />
