<br />The following significant cumulative impacts would not be mitigated to a less than significant <br />level, even with the implementation of the identified mitigation measures that are set forth below. <br />In addition to the specific findings noted below, the City of San Leandro has determined that <br />specific economic, legal, social, technological, or other considerations make infeasible the <br />project alternatives identified in the Final EIR. A discussion of project alternatives is provided in <br />Section IV of this document. <br /> <br />The City of San Leandro has determined the impact identified below is acceptable because of <br />overriding economic, social or other considerations, as described in the Statement of Overriding <br />Considerations. As required by CEQA, the Statement of Overriding Considerations is presented <br />in Section V of these Findings. <br /> <br />Cumulative Reeional Air Qualitv Impacts <br /> <br />A project's contribution to cumulative impacts is considered significant when that contribution <br />would create a cumulatively considerable addition to the overall impacts from past, current and <br />probable future projects. Development pursuant to the TOD Strategy, in combination with <br />reasonably foreseeable projects, could cause increased congestion on local streets, at <br />intersections, and on the regional freeway system, creating potential local and regional air quality <br />impacts. These increases could impede the attainment of air quality standards and is considered <br />a significant cumulative impact of the proposed strategy. <br /> <br />San Leandro is part of a region-wide non-attainment area, in which ambient levels exceed the <br />respective State or federal air quality standard for ground-level ozone, PM2.5 and PMIO. While <br />the project includes mitigation to reduce its own impacts to a level that is below the threshold of <br />sigJlificance identified for nitrogen oxides emissions by the BAAQMD CEQA Guidelines, the <br />impacts on regional air quality from this proposed project considered in combination with the air <br />quality impacts of reasonably foreseeable projects would exceed that threshold in the near term. <br />This would be a significant cumulative impact on regional air quality. Implementation of the <br />TOO Strategy, in combination with other projects occurring in the City of San Leandro, could <br />result in a significant, cumulative air quality impact. <br /> <br />The City of San Leandro finds that, as to the significant and unavoidable impact identified above: <br /> <br />The project includes mitigation measures which would lessen the project's contribution to <br />significant cumulative environmental effects, as identified in the Final EIR, but such effects <br />would continue to be significant. <br /> <br />Mitieation for Cumulative Reeional Air Qualitv Impacts <br /> <br />The TOD Strategy, in combination with other projects occurring in the City of San Leandro <br />could impede the attainment of applicable, regional air quality standards. <br /> <br />The CEQA Guidelines advise that an EIR needs to examine "reasonable, feasible options for <br />mitigating or avoiding the project's contribution" to any significant cumulative effects <br />[S 15130(b )(3)]. The Guidelines also state that the only feasible mitigation for cumulative <br />impacts "may involve the adoption of ordinances or regulations rather than the imposition of <br />conditions on a project-by-project basis" [S15130(c)]. Based on the discussion in the Final EIR, <br /> <br />27 <br />
