<br />it is concluded that ongoing conformance with current and proposed regulatory programs will <br />ultimately reduce regional air pollution in the Bay Area air basin to acceptable levels. Even with <br />the project mitigation to reduce project-related impacts to below the level of significance, the <br />cumulative impact of foreseeable future projects will be significant until implementation of <br />future technological improvements reduces the impacts from all of these sources. The <br />cumulative impact will remain significant and unavoidable in the near term. <br /> <br />The City of San Leandro also finds that as to such significant effects identified above: <br /> <br />The project includes mitigation measures which would lessen the project's contribution to <br />significant cumulative environmental effects, as identified in the Final EJR, but such effects <br />would continue to be significant. <br /> <br />Noise Impacts <br /> <br />Residences and businesses in the vicinity of development allowed by the TOD Strategy could be <br />exposed to significant construction-related vibration during the excavation and foundation work <br />associated with projects implementing the strategy. Significant, unavoidable noise impacts could <br />occur by exposing persons to noise levels in excess of local or other agency noise standards at <br />residential land uses built adjacent to the BART and Union Pacific Railroad (UPRR) lines, <br />especially on exterior balconies. Additionally, development within the TOD Strategy area could <br />result in an increase in ambient noise levels on both a temporary or periodic basis. <br /> <br />The City of San Leandro also finds that as to such significant effects identified above: <br /> <br />Specific economic, legal, social, technological or other considerations, make infeasible project <br />alternatives identified in the EJR. <br /> <br />Public Services and Recreation Impacts <br /> <br />Impacts to Schools: <br /> <br />The half mile radius of the TOD Strategy Area crosses three elementary school attendance <br />boundaries (Washington, McKinley, and Wilson) and the two attendance boundaries of the <br />District's only two middle schools (Bancroft and John Muir). All high school students generated <br />from development as part of the TOD strategy would attend San Leandro High School. <br />Population growth as a result of the TOD Strategy will impact school facilities within the TOD <br />Strategy Area. Impacts to schools and teaching facilities will be significant and unavoidable, <br />with implementation of General Plan Policies 4.03 and 46.02, and TOD Strategy EIR Mitigation <br />Measure PUB-l due to the resulting shortages in school capacity during the long-term 2025-2030 <br />time period. <br /> <br />Spec({zc economic, legal, social, technoloRical or other considerations, make infeasible project <br />alternatives identified in the EJR. <br /> <br />28 <br />
