Zoning Code Amendments 4 January 7, 2008 <br />Fences, Walls & Hedges, On-Line Auto Sales and TOD Follow-up Items <br />considered through the fence modification process that goes before the Zoning <br />Enforcement Official. <br />• The Bay-O-Vista Improvement Association met and discussed the proposed fence <br />regulations and requested that a statement be added to the zoning code amendment <br />regulating Fences, Walls & Hedges in the RS-VP District that would allow solid fence <br />material above the 3-foot fence height "if mutually agreed upon by [adjacent or affected] <br />neighbors." To address the Association's concerns, staff believes that such exceptions to <br />allow solid fence materials over the 3-foot limit are best handled through the fence <br />modification process. <br />Proposal: <br />Staff is providing the City Council with the following language regarding Fences, Walls & <br />Hedges in the RS-VP District: <br />3. RS-VP District. In order to protect the existing view corridor, the maximum <br />height of a solid fence, wall or hedge in the RS-VP District shall be no more than <br />three (3) feet above finished grade. The portion of a permitted fence between the <br />heights of three (3) feet to seven (7) feet shall be constructed with glass to allow <br />for continued enjoyment of the view. Other transparent fence materials shall be <br />considered through a fence modification permit process. Transparent materials <br />do not include chain link, mini-mesh, chicken wire, wood or lattice. Non- <br />transparent structural materials necessary for the support of the fence are <br />permitted every four (4) feet. <br />The views currently enjoyed by neighbors shall be respected. The proposed <br />construction shall not unreasonably block or diminish neighbors' views of <br />distant and scenic features, such as the San Francisco Bay and surrounding open <br />spaces and skylines, while balancing the applicant's ability to improve the <br />subject property in accordance with the applicable restrictions. <br />The Zoning Enforcement Official may modify the standards referenced herein <br />subject to the approval of a Fence Modification Permit. <br />Limited On-Line Used Vehicle Sales <br />• To accomplish the intent of these changes to the Zoning Code that allow for limited on- <br />line used vehicle sales, various Sections of the Zoning Code were amended, including <br />Article 3, Section 1-304, Definitions; Article 6, Section 2-606 and 2-612; and Article 7, <br />Sections 2-704, 2-706 and 2-708. Currently, a Conditional Use Permit is required for on- <br />line vehicle sales. However, the Planning Department has determined that limited on-line <br />vehicles sales could be allowed in certain Commercial and Industrial zoning districts, <br />provided specific requirements are met to ensure that these sales do not adversely impact <br />surrounding land uses. As a result, staff is recommending that limited on-line vehicle <br />sales be allowed as a permitted use in the CC, CS, 1L and IG zoning districts, provided <br />
