May 15, 2008 <br />Proposition 99. Official Title: Eminent Domain. Limits on Government Acquisition of Owner- <br />Occupied Residence. Initiative Constitutional Amendment. <br />• Bars state and local governments using eminent domain to acquire an owner-occupied <br />residence, as defined, for conveyance to a private person or business entity. <br />• Creates exceptions for public work or improvement, public health and safety protection, <br />and crime prevention. <br />Fiscal Impact <br />The Legislative Analyst estimates Proposition 98 may result in increased costs to state and local <br />governments due to the measure's restrictions; Proposition 99 is estimated to have no fiscal <br />impact on state or local governments. <br />CONCLUSION <br />The League of California Cities has requested member agencies to consider taking a formal <br />position in support of Proposition 99 and in opposition to Proposition 98. A copy of the current <br />City Council guidelines regarding ballot measures is attached. This matter is scheduled for City <br />Council discussion at the May 19, 2008 meeting. <br />
