archaeologist shall be consulted to determine whether any such materials are <br />significant prior to resuming round-breaking construction activities. <br />Standardized procedures for evaluating accidental finds and discovery of human <br />remains shall be followed as prescribed in Sections 15064.5 and ] 5126.4 of the <br />California Environmental Quality Act. <br />V. ENGINEERING AND TRANSPORATION REQUIREMENTS <br />A. The proposed development shall comply with City ordinances, policies and <br />regulations. All improvements shall be in accordance with the City's Design <br />Standards, Specifications and Standard Plans unless otherwise specifically approved <br />by the City Engineer. <br />B. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the <br />City HEREBY NOTIFIES the applicant for this Project that the 90-day approval <br />period (in which the applicant may protest the imposition of any fees, dedications, <br />reservations, or other exactions imposed on this Project by these Conditions of <br />Approval) will begin on the date of the conditional approval of this Project. If the <br />applicant fails to file a protest witltin this 90-day period, complying with all of the <br />requirements of Government Code Section 66020, the applicant will be legally <br />barred from later challenging any such fees, dedications, reservations or other <br />exactions. <br />C. Applicant shall pay design review fees, development impact fees, permit -fees, <br />inspection fees, and any other fees charged by the City or other reviewing agencies <br />for the review, approval, permitting and inspection of the public and/or private <br />improvements. <br />D. Site Improvement Plans for al] on-site and off-site improvements shall be approved <br />by the City Engineer prior to the issuance of Building Permits for the project. All <br />improvements shall be designed and constructed in accordance with the City's <br />Design Standards, Specifications and Standard Plans, unless otherwise specifically <br />approved by the City Engineer. <br />E. Prior to issuance of building permit, a Development Fee for Street Improvements <br />(DFSI) of $189,769.92 ($0.96 per SF of industrial warehouse space) shall be paid to <br />the City of San Leandro. <br />F. Prior to issuance of building permit, an Overhead Utility Conversion Fee of <br />approximately $209,197.32 shall be paid to the City of San Leandro for the <br />undergrounding of overhead utilities that was previously done along this section of <br />San Leandro Boulevard. <br />G. Applicant shall pay a Sewer Connection fee as required by City Ordinances and <br />regulations prior to issuance of a building permit. <br />H. The future improvements to the Interstate-880 and Marina Boulevard interchange <br />shall be funded through various sources, including fair shares from private <br />Agreement to Conditions September 6, 2007 <br />PLN2007-00040 Page 8 of 16 <br />
