EXHIBIT "B" <br />CEQA Findings and Statement of Overriding Considerations for the Approval of the <br />Kaiser Permanente San Leandro Medical Center/Mixed Use Retail Development Project <br />I. INTRODUCTION <br />1. These findings are made pursuant to the California Environmental Quality Act (Pub. Res. <br />Code Section 21000 et seq; "CEQA") and the CEQA Guidelines (Cal. Code Regs. Title <br />14, Section 15000 et seq.) by the City of San Leandro City Council in connection with <br />the EIR prepared for the Kaiser Permanente San Leandro Medical Center/Mixed Use <br />Retail Development Project ("the Project"), EIR SCH #2008012056. <br />2. These findings are attached and incorporated by reference into the May 3, 2010 staff <br />report prepared for the approval of the Project. These findings are based on substantial <br />evidence in the entire administrative record, which includes without limitation the San <br />Leandro General Plan, the San Leandro Municipal Code, the EIR prepared for the Kaiser <br />Permanente San Leandro Medical Center/Mixed Use Retail Development Project, <br />including all appendices and technical reports thereto, all applications, plans, and <br />materials submitted for the requested approvals for the Project, all reports, minutes, and <br />testimony submitted as part of the Planning Commission's February 18, 2010 hearing on <br />the Project, and all reports, minutes, and testimony submitted as part of the Planning <br />Commission's April 22, 2010 hearing on the Project. References to specific reports and <br />specific pages of documents are not intended to identify those sources as the exclusive <br />basis for the findings. <br />II. PROJECT DESCRIPTION <br />3. The Project which is the subject of the EIR is located on several contiguous properties <br />(Alameda County Assessor's Parcel Numbers between 077A-0647-001-34 and 077A- <br />0647-012-03) owned by Kaiser Foundation Hospitals, applicant and property owner, <br />located between I-880 and Merced Street, and between Marina Boulevard and Fairway <br />Drive in the City of San Leandro. <br />4. The 63 acre project site is divided into two portions, the southern portion is planned as a <br />new medical center and the northern portion is planned for a future mixed-use retail <br />development. <br />5. The maximum Project analyzed in the EIR would result in a new Medical Center of <br />approximately 1,117,000 square feet of building area exclusive of parking structures, and <br />up to 432,000 square feet of retail use. Alternatively, the retail use may be reduced to <br />387,000 square feet to accommodate either 250 units of residential apartments, or a 210 - <br />room hotel. <br />4- <br />
