therewith. and reserves the right to change the amount of any class or portion of the work or to omit portions <br /> of the work as may be deemed necessary or expedient by the Engineer in accordance with Section 3 -2 of the <br /> Standard Specifications. <br /> 2 -3 SUBCONTRACTS Contractor's attention is directed to Section 2 -3.1 of the Standard Specifications. <br /> Each proposal shall have listed therein the name and address of each subcontractor to whom the bidder <br /> proposes to subcontract portions of the work in the amount of 1/2 of one percent of his total bid or $10,000. <br /> whichever is greater, in accordance with the Subletting and Subcontracting Fair Practices Act, commencing <br /> with Section 4100 of the Public Contract Code. The bidder's attention is invited to other provisions of said <br /> Act related to the imposition of penalties for a failure to observe its provisions by using unauthorized <br /> subcontractors or by making unauthorized substitutions. <br /> The listing of proposed sub - contractors required by said Section 2 -3 of the Standard Specifications shall <br /> include a description of the portion of the work which will be done by each subcontractor. It shall also include <br /> the value of each portion of the work to be subcontracted. A sheet for listing the subcontractors. as required. is <br /> included in the proposal. <br /> Bidders are cautioned that this listing requirements is in addition to the requirement to provide a list of DBE <br /> subcontractors after the opening of the proposals. <br /> 2 -3.4 SUBCONTRACTOR AND DBE RECORDS The Contractor shall maintain records showing the <br /> name and business address of each first -tier subcontractor. The records shall also show the name and business <br /> address of every DBE subcontractor, DBE vendor of materials and DBE trucking company. regardless of tier. <br /> The records shall show the date of payment and the total dollar figure paid to all of these firms. DBE prime <br /> contractors shall also show the date of work performed by their own forces along with the corresponding <br /> dollar value of the work. <br /> Upon completion of the contract, a summary of these records shall be prepared on Form CEM -2402 (F) and <br /> certified correct by the Contractor or the Contractor's authorized representative. and shall be furnished to the <br /> Engineer. The form shall be furnished to the Engineer within 90 days from the date of contract acceptance. <br /> $10.000 will be withheld from payment until-the Form CEM -2402 (F) is submitted. The amount will be <br /> returned to the Contractor when a satisfactory Form CEM -2402 (F) is submitted. <br /> Use the next two paragraphs if DBE goals are specified. <br /> Prior to the fifteenth of each month. the Contractor shall submit documentation to the Engineer showing the <br /> amount paid to DBE trucking companies listed in the Contractor's DBE information. This monthly <br /> documentation shall indicate the portion of the revenue paid to DBE trucking companies which is claimed <br /> toward DBE participation. The Contractor shall also obtain and submit documentation to the Engineer <br /> showing the amount paid by DBE trucking companies to all firms. including owner- operators, for the leasing <br /> of trucks. The DBE who leases trucks from a non -DBE is entitled to credit only for the fee or commission it <br /> receives as a result of the lease arrangement. The records must confirm that the amount of credit claimed <br /> toward DBE participation conforms with Section 2 -1.02. <br /> The Contractor shall also obtain and submit documentation to the Engineer showing the truck number. owner's <br /> name. California Highway Patrol CA number, and if applicable. the DBE certification number of the owner of <br /> the truck for all trucks used during that month for which DBE participation will be claimed.
