Private Sewer Lateral Relocation <br /> Administrative Code Amendment 2 December 20, 2010 <br /> Analysis <br /> The necessity to abandon and relocate a sewer main is rare. The work is only performed when <br /> there is a risk to the public health and safety and when all other reasonable solutions have been <br /> exhausted. However, there is no uniform process currently available to deal with these <br /> situations. The proposed amendment to the Administrative Code provides a 12 -month process of <br /> notification, cost sharing, financial assistance, and pipeline abandonment to equitably treat <br /> property owners when these conditions arise. <br /> The major steps of this I2 -month process are: <br /> • Notify property owners of a proposed abandonment <br /> • Offer to construct a portion of new sewer lateral within public right of way at the City's <br /> expense if certain conditions are met <br /> • Offer to provide financing for construction of' the lateral that lies within private property <br /> if the work is performed in a timely manner <br /> • Provide additional notices to the property owner of the consequences if the lateral is not <br /> connected to the POTW <br /> • Disconnect the property from the POTW and provide notice that the property is <br /> uninhabitable until the lateral is reconnected at the property owner's expense <br /> Current City Council Policy <br /> Ensure well- maintained sewer facilities. <br /> City Council Committee Review and Action <br /> The proposed process was presented at the November 9, 2010 Facilities and Transportation <br /> Committee. <br /> Applicable General Plan Policy <br /> Policy 52.04: Maintain efficient, environmentally sound, and cost - effective wastewater <br /> collection and treatment services in San Leandro. <br /> Permits and /or Variances Granted <br /> Property owners would be required to obtain building permits for lateral construction. <br /> Environmental Review <br /> California Environmental Quality Act (CEQA) exemption will be filed with Alameda County, <br /> pursuant to Section 15301 "Existing Facilities ". <br />
