For required call out or court appearance on a normal work day, a minimum of two (2) <br />hours pay at the overtime rate will be paid for the first such call out or court appearance, <br />provided, however that court appearances immediately before or after schedule duty hours <br />shall be deemed an extension of the shift and the two (2) hour minimum shall not apply. <br />For required call out or authorized work related appearance on a normal day off, a minimum <br />four (4) hours pay at the overtime rate will be paid for each of the first two (2) such call <br />outs, provided, however, that a call out on a normal day off immediately before or after <br />scheduled duty hours shall be deemed an extension of the shift and the four (4) hour <br />minimum shall not apply. For court appearance on a normal day off, a minimum four (4) <br />hours pay at the overtime rate will be paid, plus payment of necessary and actual related <br />expenses. For court appearances that extend through the courts lunch period and the <br />employee is required to return on the same case that same afternoon, the employee will be <br />paid for that period of time at the overtime rate except for a one (1) hour lunch period. At <br />the employees request and with the approval of the Police Chief compensatory time off may <br />be granted in an amount equal to one and one-half time (1½) the overtime worked in lieu of <br />pay. <br />An employee assigned standby duty may elect to take compensatory time off in an amount <br />equal to the applicable hourly compensation for standby pay. <br /> <br />Police Service Dispatchers may be assigned to a pager callback list in accordance with the <br />letter of understanding signed in June, 2006. <br /> <br />Section 40. Categories of Appointment <br /> <br />The Personnel Rules regarding categories of appointment shall be amended as follows: <br /> <br /> Probationary Appointment - The appointment of a person to a position in a classification listed <br />in Appendix “A” from an employment list to serve the required probationary period for that <br />classification. <br /> <br /> Provisional Appointment - The appointment of a person to a position in a classification listed in <br />Appendix “A” as defined in the Personnel Rules. <br /> <br /> Permanent Appointment - The appointment of a person to a position in a classification listed in <br />Appendix “A” who has completed the required probationary period in that classification. <br /> <br />Temporary Appointment - The appointment of a person to a position in a classification listed in <br />Appendix “A” for a specified duration not to exceed twenty-four (24) months. The City shall <br />provide notice to the Union of all temporary appointments. <br /> <br />Section 41. Provisions Applicable to Part-time and Temporary Employees: <br /> <br />The following sections of the MOU apply as specified to part-time, permanent part-time and temporary <br />employees as they are defined below: <br /> <br />Part-Time: Hourly employees who work 999 hours or less in a fiscal year. Part-time employees shall remain <br />in probationary status. <br /> <br />Permanent Part-Time: Hourly employees working a fixed-weekly schedule for a minimum of 1,000 hours a <br />year for two consecutive fiscal years. <br /> <br />31
