<br /> 118 <br />the Board of Zoning Adjustments (BZA) shall review and either approve, con- <br />ditionally approve or deny a Residential Site Plan. <br /> <br />b. MAJOR View Preservation/Site Plan Review—Single-Story Addition and/or <br />New Home. For projects that meet the requirements for Major View Preserva- <br />tion/Site Plan Review as specified in Subsection D.1.a.i or D.1.a.ii above, a <br />public hearing is required and the Zoning Enforcement Official (ZEO) shall be <br />the decision-maker, unless the ZEO defers action to the Site Development <br />Sub-Commission (SDSC). The ZEO or SDSC shall approve, conditionally ap- <br />prove, or deny a Major View Preservation/Site Plan Review. <br /> <br />c. MINOR View Preservation/Site Plan Review. For projects that meet the re- <br />quirements for Minor View Preservation/Site Plan Review as specified in Sub- <br />section D.1.b above, no public hearing is required and the Zoning Enforce- <br />ment Official (ZEO) shall be the decision-maker, unless the ZEO defers action <br />to the Site Development Sub-Commission (SDSC). The ZEO or SDSC shall <br />approve, conditionally approve, or deny a Major View Preservation/Site Plan <br />Review. <br /> <br />a. View Preservation/Site Plan Review for Projects that Require Discretionary <br />Zoning Permits. For single-family construction projects requiring Conditional <br />Use Permit, Variance or Exception Approval (as per Subsection 1.a.iii, above), <br />the Board of Zoning Adjustments shall review and either approve, condition- <br />ally approve or deny a MAJOR View Preservation/Site Plan in conjunction with <br />its review of the Use Permit, Variance, or Exception. <br /> <br />b. MAJOR and MINOR View Preservation/Site Plan Review for Projects that Do <br />Not Require Discretionary Zoning Permits. The Zoning Enforcement Official <br />shall be the decision-maker unless the Zoning Enforcement Official defers ac- <br />tion to the Site Development Sub-Commission. The Zoning Enforcement Of- <br />ficial or Site Development Sub-Commission shall approve, conditionally ap- <br />prove, or deny the View Preservation/Site Plan. <br /> <br />4. Noticing, Review and Hearing Requirements. Prior to a decision-makers’ action on <br />an application as outlined in Subsection 3, above, public notice shall be given as <br />specified below: <br /> <br />a. MAJOR View Preservation/Site Plan Review—Height Exception and/or Large <br />Home. For projects that require Major View Preservation/Site Plan Review <br />pursuant to Subsection D.3.a above, written notification of the time, place and <br />purpose of the hearing by the Board of Zoning Adjustments (BZA) shall be <br />mailed to the applicant, property owner, and property owners within a 500-foot <br />radius from the subject site not less than 10 days prior to the public hearing. <br /> <br />City Council Hearing March 2, 2020 156
