PROPOSAL REQUIREMENTS <br /> <br />Successful proposals shall include: <br /> <br />1. Company Background (over view of company, including history, size, location and <br />ownership structure); <br />2. Three detailed examples of staff studies conducted at municipal law enforcement <br />agencies; <br />3. Detailed Scope of Work; <br />4. Cost Proposal (Compensation—Provide the proposed hourly fee schedule or flat- <br />fee schedule for services related to RFP). <br />5. References (minimum of three public sector agencies required with preference for <br />California municipalities of similar size to the City of San Leandro) <br />6. Answer the following questions regarding legal proceedings in connection with any <br />offering of municipal securities: <br />• Are there any pending legal actions alleging violations of law in connection with an <br />offering of municipal securities against the firm, any partner of the firm, or any <br />employee of the firm? Describe each such pending action. <br />• Have there been any settlements or judgements involving such actions within the <br />last five years? Describe each such settlement or judgment, including the nature of <br />the action and the amount of recovery. <br />• Are there any pending legal or disciplinary matters involving such actions <br />against the firm, any partner of the firm, or any employee of the firm by any <br />Federal or State regulatory agency? Describe each such action. <br />• Disclose all contractual or informal financial arrangements/agreements, including <br />joint accounts, fee-splitting, profit sharing and consulting agreements of your firm <br />that could impact the City. The disclosure must be complete, accurate, and in <br />sufficient detail to permit the City to make an informed decision as to with whom <br />business is being conducted. <br /> <br />Non-Collusion Affidavit <br /> <br />The Consultant declares, by signing and submitting a proposal, that the proposal is not made in the <br />interest of, or on behalf of, any undisclosed person, partnership, company, association, <br />organization, or corporation; that the proposal is genuine and not collusive or sham; that the <br />Consultant has not directly or indirectly induced or solicited any other Consultant to put in a false <br />or sham proposal, and has not directly or indirectly colluded, conspired, connived, or agreed with <br />any Consultant or anyone else to put in a sham proposal, or that anyone shall refrain from <br />proposing; that the Consultant has not in any manner, directly or indirectly, sought by agreement,
