<br /> <br />16 <br />Local 21/SLCEA Memorandum of Understanding January 1, 2025 – December 31, 2029 <br />15.4 Holiday Closure <br /> <br /> The City will notify the Union by September 1st each year if a holiday closure will <br />occur and which City functions and employees will be affected. <br /> <br />Section 16. Reallocation of Position <br /> <br />An employee in a position reallocated to a lower class shall have the right of either; (1) <br />transferring to a vacant position in their present classification provided the department <br />head into which the transfer is proposed agrees; or (2) continuing in the same position in <br />the lower classification with their salary Y-rated. <br /> <br />Section 17. Injury on Duty <br /> <br />When an employee is incapable of performing their work or duties as a result of injuries <br />received or illness arising in the course of their employment by the City and receives <br />benefits pursuant to the Workers' Compensation Act, upon the sole discretion of the City <br />Manager, a full-time employee hired pursuant to the merit personnel program may be <br />granted a leave with an amount of pay equal to the difference between their City pay and <br />the Workers' Compensation pay benefit, if any, received by them during such incapacity, <br />but not to exceed one (1) year for any one (1) period of such incapacity. Salary <br />continuation will be provided to employees injured on the job and unable to work for up <br />to the first ten days of absence. Salary continuation beyond the tenth full day of absence <br />will only be granted pursuant to the request procedure. <br /> <br />Leave granted an employee under the above provisions shall not be considered sick <br />leave or deducted from accumulated sick leave. <br /> <br />When an employee has been injured in the line of duty and receives compensation in <br />accordance with the provisions of the Workers' Compensation Act of the State of <br />California, Human Resources shall have submitted to them reports on the forms in the <br />manner prescribed. <br /> <br />An employee injured in the line of duty who requires medical care and/or physical therapy <br />shall schedule, as far as practicable, such appointments at a time so as to be as least <br />disruptive to the work schedule. <br /> <br />Modified Duty - It is the policy of the City to encourage employees to return to work as <br />soon as possible. Every effort will be made to accommodate an employee’s medical <br />needs to ensure a speedy return to work. An injured employee is required to cooperate <br />and comply with requests for information to facilitate the employee’s return to work, either <br />on a modified basis or full duties. <br /> <br /> <br /> <br />
