City of San Leandro <br />Meeting Date: December 7, 2015 <br />Resolution - Council <br />Agenda Section:File Number:15-659 CONSENT CALENDAR <br />Agenda Number: <br />TO:City Council <br />FROM:Chris Zapata <br />City Manager <br />BY:Rich Pio Roda <br />City Attorney <br />FINANCE REVIEW:David Baum <br />Finance Director <br />TITLE:RESOLUTION Approving a Letter of Understanding to Amend the <br />Employment Agreement for the City Manager Chris Zapata in Regards to <br />Employer Paid Member Contributions (EPMC) Retirement Benefits to Comply <br />with CalPERS Regulations <br />WHEREAS, due to an audit conducted by the California Public Employees’ Retirement <br />System (CalPERS) the City Manager Agreement for Employment must be amended; <br />WHEREAS, CalPERS recommends that the City Manager and Assistant City Manager <br />should be grouped together as similarly situated non-represented executive management <br />employees for the purposes of Employer Paid Member Contributions (EPMC) retirement <br />benefits; <br />WHEREAS, the City Manager would receive the same EPMC as specified in the <br />Assistant City Manager’s employment agreement for the period January 1, 2013 through <br />December 31, 2017; <br />WHEREAS, the City Council of the City of San Leandro and City Manager Chris <br />Zapata were made aware of the CalPERS audit finding and recommendations to come into <br />compliance with CalPERS regulations; and <br />WHEREAS, the City Council of the City of San Leandro and City Manager Chris <br />Zapata desire to amend the City Manager’s contract through a Letter of Understanding, which <br />shall be attached to and made a part of this resolution. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That the Letter of Understanding to amend the Agreement for Employment for City <br />Manager Chris Zapata is hereby approved and execution thereof by the Mayor is hereby <br />authorized. <br />Page 1 City of San Leandro Printed on 12/1/2015
